Online elegy for FOI: Netizens sad, angry PNoy, LP killed bill

The FREEDOM OF INFORMATION (FOI) bill would not fade away at all, even as it actually dies today in the 15th Congress through sheer inaction and deliberate delays by President Aquino and his Liberal Party allies in the House of Representatives.

Netizens of the country have kept the spirit of the FOI bill alive in hundreds of tweets and comments they have posted in the last five days alone. The PCIJ gathered a bountiful harvest of these comments from various news media websites and Twitter accounts.

The tweets came from accounts bearing the hashtags #SaveFOI, #PassFOI, #CertifyFOI, #FOInow, #FOI, and @PcijDotOrg. The comments and feeback, on the other hand, are a string of those posted in response to FOI stories posted on GMANews Online. inquirer.net, abs-cbnnews.com, and philstar.com in the last week.

To a majority, including pop-culture icon Noel Cabangon, reportedly a favorite artist of Aquino, the failure of the 15th Congress to pass the FOI bill was either disappointing or reprehensible or revolting.

“Dear Congress, don’t be murderers. Don’t kill our right to information, don’t kill our hopes for a transparent government,” Cabangon twitted. “We want a transparent and acceptable government. We want leaders we can trust.”

A citizen seconded the idea.”And daang matuwid babaluktot pa rin kung walang FOI,” wrote Rommel S. Agan.

Another who watched a report on the FOI bill that aired on the program Reporter’s Notebook, drew a sharp contrast between the non-passage of the FOI bill and the quick action that Congress took to declare the waling-waling a national flower of the Philippines. Nick twitted: “Buti pa yung batas sa waling-waling umabot sa pagtatapos ng 15th Congress. And FOI bill sinukuan na lang:(”

Citizen FernandoBusi said the FOI bill’s aborted passage should be an issue in the next elections this May.”No FoI, NO LP (Liberal Party) in 2013.”

Death watch for FOI: Belmonte surrenders, PNoy chief obstacle

IT’S THE EVE of the last session day of the House of Representatives, and the death watch for the Freedom of Information (FOI) bill has begun.

By all indications, the election campaign — not the FOI nor any other reform bills — is on top of mind of a majority of lawmakers seeking re-election or higher office on May 13, 2013.

But first, let’s do a wrap of differently pegged stories about the gasping-for-life FOI bill.

First, the story of surrender by Speaker Feliciano Belmonte Jr. and Rep. Ben Evardone, House committee on public information chairman. In a repot on Monday by GMANews Online, Belmonte pronounced the FOI bill “technically” dead.

He dashed all hopes that the FOI bill could still pass, with the House holding its last three session days this week. The lack of time, he said, would not allow for vigorous debate on the bill. “We cannot just curtail interpellation. May mga gustong mag-interpellate.”

Days earlier, Evardone himself had said he was waiving the white flag of surrender, then proclaimed the FOI bill dead. Yet just as quickly, Evardone was named as a co-spokesperson of the ruling Liberal Party coalition and its official candidates in the May 2013 elections.

The outlook for FOIbill’s passage is grim yet Belmonte said there was still a “slim chance” to pass it, if President Benigno Aquino will only certify it as urgent. “If the President certifies it, we can meet beyond Wednesday and Thursday. In that sense, there’s still that slim chance. Hanggang alas-dose ng gabi, basta huwag lang mawala ang quorum,” Belmonte said.

But Aquino has been tagged as the main stumbling block to the quick passage of the bill in a second story that an international group of freedom of information advocates ran days ago.

Titled “Lack of Aquino Support Seen Dooming Philippines FOI Bill,” the story was posted online at www.freedominfo.org, a global network of FOI advocates.

The story lamented the President’s position, as relayed by Presidential spokesman Edwin Lacierda on Jan. 31: “Our position is let’s have a debate, a healthy debate on this issue and we’ll take it from there.”

Freedominfo.org cited reports quoting House members saying that Aquino does not want the bill passed.

Atty. Nepomuceno Malaluan was quoted in the story as saying that Lacierda’s “healthy debate” proposition is “an insult,” adding that Aquino and Lacierda knew full well “that the House leadership had used every parliamentary trick in the books to prevent any debate from happening.”

Freedominfo.org took notice of interviews in the Philippines press by various lawmakers who categorically said Aquino himself did not like the FOI bill passed.

For instance, Isabela Rep. Rodolfo Albano, a member of the minority bloc, had told the Inquirer that, “I heard that the Malacañang is not for it.”

The Manila Standard also quoted Albano as saying that Aquino
“does not like the FOI bill. That’s what I gathered from Palace sources.”

in addition, House Minority Leader Danilo Suarez had said, “If they want the FOI they can just ram it through our throat.” Speaking at a news conference, he added: “But obviously, the Palace itself is not interested in passing the bill.”

Meanwhile, CIBAC Party-list Rep. Sherwin Tugna was quoted to have said in a Jan. 29 news report that, “FOI is not supported by Malacañang.”

Freedominfo.org also cited remarks made by FOI bill co-author Rep. Walden Bello. “I don’t really know what Malacañang priorities are at this point. In fact, I am not sure if the House leadership wants this bill to get through.”

Yet still a third story to the last raised a challenge to House lawmakers and Aquino: Pass the FOI bill.

In a statement, youth leaders of the University of the Philippines (UP) DARE Movement said: “Higit kailan, napapanahon na ang pagpasa ng Freedom of Information Bill na matagal nang iniwan sa lugmok na sitwasyon ng ating mga mambabatas.”

Men in black fire upon 4 cars of Thai TV station in Bangkok

A SHOOTING ATTACK on four cars belonging to television station ASTV in Thailand that was carried out by unidentified people early morning of Jan. 26, 2013 has raised serious concern from the Reporters Without Borders (Reporters Sans Frontieres or RSF).

“Spraying a news organization’s vehicles with bullets is a serious act,” RSF, a press freedom organization based in France, said in a statement. “The attack is a reflection of the current hostile climate for journalists and those who work in news and information in the country.”

RSF said the investigation being carried out by the authorities “must be concluded quickly so that those behind the crime are held to account for their actions.”

“The authorities must also take action to stem the tide of violence and threats against the media and to protect the right to information,” it added.

According to RSF, the attack took place at the head office of ASTV at the Baan Chao Phraya building, on Phra Athit Road in Bangkok. It was only when ASTV journalists arrived at the site
the following morning that the attack was discovered. Four cars were riddled with bullets, believed to be from a .22 calibre gun, RSF reported.

After checking video surveillance footage, the police police said a man dressed in black was seen approaching the scene about 3:25 a.m. on Jan. 26.

General Kamronwit Thoopkrachang, chief of the Metropolitan Police Bureau, said the motive for the attack was not known, RSF said.

The ASTV group is close to the People’s Alliance for Democracy (PAD), which consists of opponents of the current government who are popularly known as the “yellow shirts”.

A few days earlier, RSF said soldiers held a demonstration outside the PAD’s headquarters to protest its criticism of the head of the armed forces, General Prayuth Chan-ocha.

RSF said Gen. Prayuth has denied that any soldiers were involved in the attack on ASTV.

De Lima speaks out for FOI; P-Noy, Cabinet, LP shut up

HERE’S a story of guts — the lone voice in President Aquino’s Cabinet who has come out openly, strongly, clearly for the passage of the Freedom of Information bill.

Nearly all the rest of them, meanwhile, has chosen to shut up, pay lip-service or feign support the reform measure.

On Friday at an international conference of parliament members avowedly committed to fighting corruption, Justice Secretary Leila De Lima spoke: “The governance philosophy of President Benigno S. Aquino III of tuwid na daan or the “straight path” has harvested gains in our relentless anti-corruption campaign.”

Here’s more: “But it is noted that certain conditions have to be engendered in order for the right to information to be meaningfully practiced. One fundamental requirement is the passage of Freedom of Information laws.”

And more: “Notwithstanding the continued difficulties in making effective FOI legislations, I believe most, if not all the people in this room, agree with me that freedom of information is THE most effective modality to prevent corruption. It’s basic premise is that a well-informed citizenry can and will meaningfully participate in the governance of a country. Indeed, one of the aspirations of institutionalizing the Freedom of Information principle in our country is for our people to enjoy economic and social mobility as anticipated fruits of political maturity.”

De Lima spoke before the conference of the Global Organization of Parliamentarians Against Corruption (GOPAC) held at the Philippine International Convention Center in Manila.

The justice secretary who had served also as chairperson of the Commission on Human Rights, stressed that the citizen’s right to information is “recognized globally.”

“For instance,” she said, “the International Covenant on Civil and Political Rights (ICCPR) clearly recognizes the individual’s two-pronged right to seek AND to impart information.”

Abad calls PCIJ story ‘unfair’; Peralta vows to recheck SALN

BUDGET and Management Secretary Florencio B. Abad and Supreme Court Associate Justice Diosdado M. Peralta in separate letters have reacted to recent stories published by the PCIJ regarding transparency issues in government.

In a letter dated Jan. 28, 2013, Abad disputed a paragraph in PCIJ’s story titled “PH budget transparency score slips 7 pts; oversight improves,” which was authored by Karol Ilagan.

Abad wrote:

In the report, Ms. Ilagan wrote that “a global report now reveals that Filipinos continue to be denied full access to budget information and documents.”

He added: “The latest figure is a throwback to the Philippines score in 2008: exactly 48. This only means that the Aquino government, just like the Arroyo administration, has made it harder for citizens to get information on how public officials and government agencies are spending taxpayers’ money.”

Abad described this portion of the PCIJ story as “sweeping” and “unfair.”

He continued: “While we respect and recognize the methodology used for determining the country’s rating in the Open Budget Index, we take exception to Ms. Ilagan’s statement that it is even more difficult for Filipinos to obtain key information on public expenditure activities under the Aquino administration. That is too sweeping. We also question her assertion that this year’s rating for the Philippines effectively likens the current leadership to the Arroyo administration, which is notorious for its lack of transparency and accountability in public fund management. That is unfair”.

The PCIJ stands by its story. The reference to the Arroyo administration as the government in power in 2008 was made as a matter of factual context. The Philippines’ score in the 2012 Open Budget Index (OBI) dropped seven points, from 55 in the 2010 OBI. This slide could not have been written as easing up the process for citizens to get information on how government officials and agencies are spending taxpayers’ money.

The story had properly acknowledged the efforts of the DBM in uploading online more public finance documents. Additionally, the story also cited two letters and follow-up phone calls made by the PCIJ over the last year for copies of zero-base budgeting documents (uploaded finally in March 2012) and records of disbursement of lump-sum funds by the President. To this day, the DBM has not acted on these requests.

Meanwhile, on Dec. 17, 2012, Justice Peralta wrote to PCIJ to clarify the discrepancy between the income enrolled in his Statement of Assets, Liabilities, and Net Worth (SALN) and the Commission on Audit’s 2011 Report on Salaries and Allowances (ROSA), which was discussed in PCIJ’s story titled “SC justices among PH’s best paid, allowances, bonuses not in SALNs” written by Malou Mangahas and Ilagan.

Peralta wrote:

“I read your report that was published in the Manila Times dated December 10, 11, and 12, 2012. As it appears in your report, the income that I derived from the Supreme Court is P4.3 Million, while the COA Report states that the total income I received from the Supreme Court is P3,995,575.29, thereby making a difference of P326,487.66. In short, I misdeclared the income I received from the Supreme Court. I believe that your conclusion is inaccurate because the allowances I received from the House of Representatives Electoral Tribunal in the amount of P933,799.98, Philippine Judicial Academy in the amount of P25,000.00, and dividends from Supreme Court Savings and Loans Association in the amount of P63,000.00 or the total amount of P1,021,799.98, did not come from the Supreme Court. Those said institutions are separate and distinct from the Supreme Court and are not considered as income derived from the latter. Hence, if you deduct the said amount of P1,021,799.98 and the P450,000.00, proceeds of the sale of the guns from the total amount of my declared income of P4,772,062.94, then it would readily show that the amount I received from the Supreme Court and reported in my SALN is only P3,300,262.96, which is less than the amount of P3,995,575.29 that appears in the COA Report or a difference of P695,312.33. It would therefore seem that the income derived from the Supreme Court which I declared in my SALN is much less than that of the amount in the COA Report.

“I appreciate though your report because it was only then I came to know of the amount I supposedly received from the Supreme Court based on the COA report. This immediately prompted me to write Ms. Araceli C. Bayuga, the SC Chief Judicial Staff Officer of the Cash Coll. and Dis. Div., Fiscal Management and Budget Office of the Supreme Court and asked her to provide me with an explanation as to the discrepancy of the two (2) amounts considering that the income derived from the Supreme Court which I declared in my SALN came from her office. Whatever is the result of my inquiry, the same shall be reflected in my 2012 SALN in order that the correct data maybe reflected and recorded.”
